We were appointed by Richard Sanderson to support a planning application for a small residential development in the village of Kingston, Devon. The development proposed nine new homes, as a village extension.

APPROACH

A planning application was prepared and submitted in 2018. We prepared supporting documentation, including a Transport Statement and access drawings.

Devon County Council, the Highways Authority, objected to the proposals, stating that there would be an intensification in the number of vehicles at a nearby cross-road junction. They perceived this to be highway safety issue.

OUTCOME

The application was subsequently refused for highway safety reasons, and for heritage reasons, given the setting of the local church.

The applicant appealed the refusal of the application. We provided representations against the reason for refusal on highways safety grounds.

The inspector dismissed the appeal. However, with regards to the highways safety reason for refusal, the inspector stated…”I concur with the appellant’s highways consultant and conclude that the proposals would be unlikely to compromise highway safety interests”
